This Privacy Policy explains how KYBR (“KYBR”, “we”, “us”, or “our”) collects, uses, stores, and protects personal information when you use our services. By using KYBR services, you agree to the practices described in this Privacy Policy.

  • KYBR software and automation systems
  • Communication and messaging services
  • Any related services operated by KYBR

2. Information We Collect

2.1 Information You Provide

  • Name
  • Email address
  • Phone number
  • Business name and details
  • Messages or inquiries submitted through forms or communication channels
  • Information provided during onboarding or setup

2.2 Information Collected Automatically

When you interact with KYBR services, we may automatically collect:

  • IP address
  • Browser type and device information
  • Device, browser, and usage information, including performance and interaction data
  • Pages or features accessed
  • Usage logs and system interaction data

2.3 Communication Data

When using KYBR communication tools, we may process:

  • Phone call metadata or content (where enabled)
  • SMS messages
  • Appointment requests or scheduling data
  • Customer inquiries and responses
  • System-generated summaries or logs

3. How We Use Information

KYBR uses personal information to:

  • Provide and operate services
  • Enable communication features (calls, SMS, scheduling)
  • Configure and personalize services based on client setup

4. Automated Systems & Processing

KYBR services may use automated systems to assist with communication and workflow processing. These systems may:

  • Process and respond to incoming messages or calls
  • Assist with scheduling or lead handling
  • Generate structured summaries or responses based on inputs

Automated systems are used to support business operations and may not always reflect human judgment. Clients and users acknowledge that automated processing may vary depending on inputs, configuration, and external system dependencies.

5. Consent

KYBR relies on appropriate forms of consent for the collection, use, and disclosure of personal information, including express or implied consent where permitted under applicable law. Where required, individuals may withdraw consent, subject to legal or contractual limitations.

6. Disclosure of Information

KYBR does not sell personal information. We may disclose personal information only where necessary:

  • To deliver services
  • To enable integration with third-party service providers necessary for service delivery
  • To comply with legal obligations
  • To enforce agreements or protect legitimate business interests

7. Third-Party Service Providers

KYBR may use third-party providers for:

  • Communication services (SMS, telephony)
  • Calendar and scheduling systems
  • CRM and workflow tools
  • Hosting and infrastructure services

These providers may process data on our behalf solely to support service delivery.

8. Data Storage & Cross-Border Processing

Personal information may be stored or processed outside of Ontario or outside of Canada using third-party infrastructure providers. Where this occurs, KYBR takes commercially reasonable steps to ensure that personal information is handled in a manner consistent with applicable Canadian privacy principles, subject to applicable foreign legal jurisdictions.

KYBR implements commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or misuse. KYBR’s website and services use HTTPS encryption for data transmitted over the internet. Security measures are designed to be appropriate to the nature of the services and supporting infrastructure.

KYBR retains personal information only for as long as necessary to:

  • Provide services
  • Maintain operational records
  • Comply with legal obligations
  • Resolve disputes
  • Enforce agreements

Retention periods may vary depending on the type of data and purpose of collection.

Individuals may request access to their personal information held by KYBR and may request corrections where information is inaccurate or incomplete, subject to legal exceptions.

KYBR may use cookies or similar technologies to:

Users may disable cookies through browser settings, but some features may not function properly as a result.

13. Web Design Services

This section describes how information is handled in KYBR’s website design and development service, where KYBR builds and hosts a website on behalf of a Client. It is in addition to the rest of this Policy.

13.1 Information Provided by the Client

To build a website, KYBR collects and uses the material a Client supplies, which may include:

  • Business name, address, service area and contact details
  • Descriptions of services, pricing and hours
  • Photographs, logos and other media
  • Staff names, roles or biographies where the Client asks for them to be published

Material supplied for publication is published on the Client’s website and is therefore public. Clients are responsible for confirming they hold the rights to any material they supply, and for obtaining consent before supplying information about identifiable individuals such as staff members.

13.2 Visitors to a Client’s Website

A website built and hosted by KYBR processes information about the people who visit it. This includes:

  • Hosting and delivery logs, including IP address, browser and device information, and requested pages, used to serve the site, keep it available and protect it from abuse
  • Enquiry and quote form submissions, which are transmitted to the Client and filtered for spam
  • Click-to-call and booking interactions, where conversion tracking is enabled on the Client’s plan
  • Analytics data collected through Google Analytics 4 and Google Search Console, which are connected as part of the build

KYBR processes this information on the Client’s behalf in order to operate, secure and measure the Client’s website. The Client is the organisation that visitors are dealing with, and the Client remains responsible for its own obligations to those visitors, including publishing its own privacy information and obtaining any consent required before contacting them. Section 7 applies to the third-party providers used to deliver these functions.

13.3 Hosting Location

Websites are served from a global content delivery network, which means page requests are handled by whichever server is closest to the visitor. As set out in Section 8, this may involve processing outside Ontario or outside Canada.

13.4 Google Business Profile

Where a Client opts in to having KYBR set up a Google Business Profile, the profile is created in the Client’s name with owner access held by the Client. KYBR takes manager access only, in order to maintain the profile and keep it connected to the website, and the Client may remove that access at any time.

13.5 If the Website Leaves KYBR

Where a Client exercises the Buyout Policy described in the Terms of Service, KYBR hands over the website files and the associated accounts, including analytics access. Responsibility for the information processed by the website, and for the privacy obligations attached to it, transfers to the Client at that point.

14. Children’s Privacy

KYBR services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children.

15. Changes to This Policy

KYBR may update this Privacy Policy from time to time. Continued use of services constitutes acceptance of any updated version.
